Jim DeMint: The most undemocratic senator?

Demint The Times has long opposed filibusters and holds in the Senate (yes, even during the Bush years) on the grounds that both procedures are fundamentally undemocratic and require a level of mutual respect that no longer exists in Congress. Recent examples of such procedural abuse abound in Congress; a particularly egregious case was when Sen. Richard C. Shelby (R-Ala.) placed secret holds on 70 of President Obama's nominations to win terms more favorable to his state on an Air Force contract to build aerial refueling tankers. Shelby's obstructionism was undemocratic, but his reasons for holding Obama's nominations hostages were clear.

Not so with Sen. Jim DeMint, the South Carolina Republican threatening to effectively shut down Congress until Election Day in November by placing holds on all legislation not cleared by his office by the end of Tuesday. Politico reports:

South Carolina Sen. Jim DeMint warned Monday evening that he would block all legislation that has not been cleared by his office in the final days of the pre-election session.

Bret Bernhardt, DeMint's chief of staff, said in an e-mail to GOP aides that his boss would place a hold on all legislation that has not been cleared by both parties by the end of the day Tuesday.

Any senator can place a hold to block legislation — and overcoming that would require the Senate to take time-consuming steps to invoke cloture, which would require 60 votes.

With the Senate slated to adjourn Thursday until after the elections, DeMint's stance could mean trouble for Democrats if the two parties don't quickly agree on a stopgap spending measure to keep the government operating past Sept. 30. And that could mean the demise of a slew of other stalled and largely noncontroversial bills that both parties are looking to clear before Election Day.

Filibusters require at least some unity among the minority party (and perhaps a few sympathetic Democratic senators); holds, on the other hand, have the potential to turn Congress into a sort of legislative dictatorship. DeMint's action serves no purpose other than to make him the most powerful man in the Senate, even denying his own minority leader Mitch McConnell the ability to negotiate with Democrats.

DeMint just became the poster child for killing holds.

This process should be eliminated regardless of whoever is in the majority. I do not think invoking such action by a Legislator is helping expedite needed legislation.

Really makes you want to run out and vote for a party and a guy (demint) that promises to destroy the country.

Obviously, this guy masturbated on his picture. Themore I see and hear, I will vote for the Democrats.


It's amazing to me, that you failed to mention the dems are and will propose 20 new bills after 11-2-10 [lame duck] session. They also will not vote on the tax exstentions until after 11-2-10. Why? Liberals and progessives duck the real problems they've created and refuse and to admit their own responsibilty for the last distructive 18-20 months

@bob, do you really believe DeMint's unilateral hold and passing some significant bills in a lame-duck sessions (via majority vote) are equivalently undemocratic?

Anyone honest with themselves, not relying on emotion, but on fact – knows the federal government makes a disaster of everything they get their tentacles on – compared to what private industry is doing. So why are we allowing gov. control of the banks- including student loans, auto industry, and health care? --- We are allowing the current administration, - the neo-democrat socialist party, tell us that the corporations are evil, and the rich can afford to be taxed – pandering to our sense of retribution, and greed. I'D RATHER DEAL WITH A CORRUPT CORPORATION – THAN A CORRUPT TOTALITARIAN GOVERNMENT.
The evil CAPITALISTIC corporations - where many people have their retirement funds, that are getting decimated, and people have lost their jobs, because corporations, like people can only take so much s***.
Some people that are scared, because they know what socialism/communism is, and see it happening to America; they go to TEA parties/meetings – freedomworks-org gives some solace to these people; a visit to this site shows TEA people are not far right radicals. As can be seen in their mission statement freedonworks-org supports candidates with character, and values, and have a history that shows concern about Americans. TEA people are not far right radicals – many are people concerned about the pain America has been forced to deal with. Doing some research shows who the real radicals are, - and the people that state the White House is taken over by the far left/we are getting attacked from within are stating the truth – this is not a radical statement.
The future of America's health “care” is going to be like other totalitarian countries/Greece/Europe judging by obvious omens, --- such as Obama's nominee to head Centers for Medicare and Medicaid Services (CMS), Donald Berwick – who evidently thinks the best system is ration-based single-payer -

This healthscare scheme involves more new departments than carter has pills; people (many “rich”) will go to other countries to get their healthcare – this equals more revenue taken from American citizens.
